New draft regulations to the Preferential Procurement Policy Framework Act ("PPPFA") have recently been published for comment. The PPPFA and the related regulations form the legislative framework which governs all procurement processes run by the State.
Any person / company engaged in business with the State (including any government departments, State Owned Enterprises and municipalities) via the tender process will need to be aware of these new draft regulations. If the new regulations are implemented in their current form, they will significantly alter the criteria in terms of which almost all bids for government contracts may be provided and the terms on which they will be assessed. The new draft regulations will repeal the current applicable regulations (which came into effect in 2011) in their entirety. Submissions on the new draft regulations (available here) are requested by 15 July 2016.
