Tacit contract - conduct and circumstances giving rise to such contract must be pleaded - otherwise pleading vague and embarrassing.

Contract subject to a suspensive condition - pleading must state whether condition fulfilled in order to give rise to rights and obligations - failure to furnish this information makes pleading vague and embarrassing.
