Exceptions - vague and embarrassing - requirements for such a finding. Tacit contract - conduct and circumstances giving rise to such contract must be pleaded - otherwise pleading vague and embarrassing. Rule 18(7)- distinction between tacit term of a contract and a tacit contract. Rule 18(7) only of application in first case. Contract subject to a suspensive condition - pleading must state whether condition fulfilled in order to give rise to rights and obligations - failure to furnish this information makes pleading vague and embarrassing.
