The Public Servants Association (PSA) supports the appointment of Advocate Andy Mothibi, former Head of the Special Investigating Unit (SIU), as the National Director of Public Prosecutions (NDPP).
Advocate Mothibi’s tenure at the SIU was characterised by stability, institutional renewal, and strengthened public confidence in the work of the Unit. Under his leadership, the SIU firmly reasserted its relevance and demonstrated its critical role in the fight against corruption and maladministration. The impact of his work has been visible and recognised nationally.
The PSA is confident that Advocate Mothibi will bring the same level of integrity, decisiveness, and stability to the National Prosecuting Authority (NPA), at a time when strong leadership is essential to restore trust in the criminal justice system and ensure accountability without fear or favour, especially in light of the explosive evidence that is currently being heard at the Madlanga Commission.
The President must ensure that the NPA is provided with the necessary resources and has enough prosecutors appointed without delay. The NPA, without enough budget, even Advocate Mothibi would find it difficult to succeed in this critical task. Prosecutors across the country are working under immense pressure, in dilapidated, unsafe buildings that are not fit for purpose. The lack of basic resources, including functional office infrastructure, technological tools, and sufficient administrative support, severely hampers their ability to effectively perform their duties. Compounded by unmanageable caseloads and chronic understaffing, these conditions affect the quality of work, impact on staff morale and contribute to burnout.
The PSA is further concerned about glaring salary disparities between prosecutors and their counterparts in the private legal profession. These professionals, tasked with safeguarding justice, are not remunerated in a manner that reflects the complexity and significance of their work. This disparity is demotivating and undermines efforts to attract and retain skilled prosecutors.
The PSA further welcomes the acting appointment of Mr Leonard Lekgetho, who is the current Chief Operations Officer of the SIU, as the Acting Head of the SIU. The PSA is pleased that leadership continuity is being maintained from within the SIU family, ensuring institutional memory, operational stability, and the continuation of the trusted relationship the SIU has built with the public.
The PSA remains committed to supporting public institutions and their leadership in strengthening governance, upholding the rule of law, and advancing ethical public service in South Africa.
