The successful legal action of Solidarity against the department of correctional services (DCS) is a victory against the unfairness of affirmative action and Black Economic Empowerment (BEE) against minority groups such as white and brown people in South Africa, Dr. Pieter Groenewald, the Freedom Front Plus’ parliamentary leader said.
Dr. Groenewald says the judgment is proof that the FF Plus has consistently been on target with its condemnation of the discriminatory policy.
“This judgment must be a huge embarrassment for the ANC government as it comes a day after the comments of Dr. Rob Davies, the minister of Trade and Industry that BEE has not disadvantaged or harmed a single person in South Africa.
“The president also said on the 21st March this year in parliament that he does not know any person in South Africa who had been negatively affected by this policy.
“The president and the ANC can just look at this judgment to find confirmation of the fact that people are affected by it, that they are denied opportunities and that it could impoverish them.
“Government could also note that South Africa and the world will take note of this judgment and that the damaging effect of BEE will not be deniable as easily as before.
“The case could be viewed as one which could permanently change affirmative action in the public service but also in other sectors,” Dr. Groenewald said.
Dr. Groenewald says the FF Plus will continue to oppose the unfair policy with all possible means in the interest of everyone in South Africa who is affected by it and that the party will also support any attempts to oppose the policy.
