The Political Funding Act 6 of 2018 (Funding Act) – ss 9 and 12, read with Regulations 7, 8 and 10 of the Regulations regarding the Funding of Political Parties issued in terms of s 24(2) of the Funding Act – whether the respondents have complied with their obligations in terms of s 9 and s 12, read with reg 10, of the Funding Act to account for their income – the circumstances under which the Electoral Commission may approach this Court for an order imposing administrative penalties on the respondents – whether a proper case is made out for this Court to impose administrative penalties on the respondents as prayed for by the applicants – Application succeeds – declaratory orders granted against respondents – administrative penalties imposed as envisaged by s 18 – No order as to costs.
