The Young Communist league of South Africa(uFasimba) welcomes the withdrawal of the unfounded case by the National Prosecutions Authority against Mzilikazi Wa-Afrika. This affirms that there was no substantial evidence in the first instance to arrest him. This comes after a theatrical arrest of Mzilikazi Wa-Afrika by the Hawks at his work place.
As the YCLSA we believe that Law enforcement should never be used as a means to silence the media, equally journalists are compelled to report facts and ensure that their reporting is responsible and not vindictive. Unfortunately within the parameters of the media, we have witnessed gutter journalism and reporting which has dragged names of people in the mud. Such journalists should be held accountable and if there is an infringement of the law, due process needs to follow. Hence our support for the Media Tribunal.
We should at all times protect the independence of our judiciary. We should not go back to days where state organs were used as a political weapon to settle scores and silence those that were seen as a threat to power.
Our constitution enshrines freedom expression and media freedom and we will continue to defend that. However we equally condemn unprofessional journalistic work that compromises other people's public standing, where unfounded allegations are made public and the media turns a court of law. If there is no concrete evidence to prosecute Mzilikazi, all charges must be permanently set aside.
