This is an appeal from the judgment of Msimang J (as he then was) dated 6 July 2009, finding for the respondent on the main action with costs against the appellant. At the Court a quo the appellant lodged an application for leave to appeal which was refused. With the leave of the Supreme Court of Appeal the appellant has appealed to this Court. Ms Lennard appeared for the appellant and Mr Ungerer for the respondent.
