On Thursday, 19 July trade union Solidarity will file papers at the Johannesburg Labour Court, requesting that the entire affirmative action plan of the South African Police Service (SAPS) be declared invalid, because it conflicts with the Employment Equity Act and the Constitution of South Africa. In the papers, Solidarity focuses on the SAPS’s enforcement of quotas according to the national racial demographics.
Should Solidarity’s application be successful, it could have far-reaching consequences for the entire public service, as other government departments’ affirmative action policies are based on the same principle.
It will be the first time that the Labour Court is requested to declare the SAPS’s entire plan invalid. Solidarity has already taken the SAPS to court in 14 separate cases to date.
