The Department of Mineral Resources (DMR) has taken note of the judgment handed down in the North Gauteng High Court today in the matter between AgriSA and the Minister of Minerals and Energy, in which the Court has found on the facts of the particular case that the plaintiff was expropriated of its common law unused old order mineral rights by operation of law.
Obviously the DMR is disappointed by the outcome. The DMR is currently studying the judgment and will be taking legal advice from its legal team in deciding on an appropriate course of action.
