The plaintiff has instituted a claim for damages consequent upon his alleged unlawful arrest and detention. It is common cause that on the 29 May 2007 the plaintiff was arrested without a warrant and detained at the Randburg Magistrate Court’s holding cells–by members of the South African Police Services acting within the course and scope of their employment with the defendant–before being “released on warning” pursuant section 72 of the Criminal Procedure Act 51 of 1977 “The Act”.
