Public Protector to meet Auditor-General over SGL complaint

The Public Protector is meeting the Auditor-General regarding a probe into tender procedures at the Limpopo municipality, which awarded a contract to SGL Engineering, the Public Protector said on Monday.

"We are meeting with the Auditor-General on Thursday for the possibility of a joint investigation," said advocate Thuli Madonsela.

"These are finance issues and the Auditor also knows what needs to be done, they also have forensic experts," she said in Pretoria, where the Public Protector's national stakeholder meeting is being held.

Complaints have been submitted to the Office of the Public Protector over a contract awarded to SGL Engineering, in which African National Congress Youth League (ANCYL) President Julius Malema reportedly has a majority shareholding.

Complaints have also been made about alleged irregular tender procedures in the Limpopo Municipality.

The City Press newspaper reported that several multi-million rand bridges and roads built in Limpopo by SGL Engineering Projects were washed away within weeks of their completion.

Malema has claimed that he was not aware of his directorship in the company, according to his lawyers.

Madonsela said that her investigating team had not yet started on the complaints in the Limpopo municipality.

She said that both a "specific" and a "systemic" probe would take place of the municipality.

"We are investigating the possibility of tender irregularities in the municipality ... We have extended it beyond SGL," she said.


She said that the tender irregularities were sometimes difficult to probe.

"I think that the only thing that we will investigate is whether the people who got the tender got it properly in terms of procedure and are qualified for it," she said.

The Public Protector would look at whether the correct procedures had been followed, whether the company fitted the criteria required for the specific job and whether the payments followed the required quality assurance procedures.

Her fieldworkers had not started on the Limpopo complaints as they were busy in Balfour, Mpumalanga.

During the stakeholder meeting, Madonsela outlined her strategic plan to, among other things, reduce case turnaround times, establish a new unit focusing on government and integrity issues, and increase communication with communities and the public.

Implementation of the plan was subject to the securing of funds from the government.
