The North Gauteng High Court in Pretoria is expected to deliver its ruling on Friday on whether or not President Jacob Zuma should immediately implement the remedial action recommended by the Public Protector in her “State of Capture” report.

Former Public Protector Thuli Madonsela ordered earlier in 2017 that within 30 days Zuma must establish a judicial commission of inquiry led by a judge appointed by the chief justice, but the President has taken her remedial action on review.

In his court application, Zuma says the remedial action undermines the President’s constitutional authority to institute such proceedings.

However, the Democratic Alliance (DA), which brought the matter to court, argues that the review proceedings do not suspend the implementation of the remedial action.

Although the party is aware of Zuma’s review application to be heard towards the end of October, it insists that this development does not suspend the Public Protector’s remedial action since he not interdicted the process.

The DA wants the court to compel Zuma to implement the remedial action.

Judgement is expected today in high court in Pretoria today.
