The Minister of Water and Environmental Affairs made the Regulations regarding the Safety of Dams as set out in the schedule to the notice. The Regulations make provision for, inter alia, the following provisions:
- Definitions;
- Classification of dam with safety risk;
- Use of classification of dam with safety risk;
- Requirements for issuing of licence to construct, enlarge, alter or repair dam with safety risk;
- Licence to impound water in dam with safety risk;
- Keeping of records, storage of documents, change of ownership and change of use;
- Registration;
- Decommissioning; and
- Offences and penalties
The effect of the above publication is that the Regulations promulgated in terms of section 9C(6) of the Water Act 54 of 1956 relating to Dams with a Safety Risk (GNR 1560 of 25 July 1986) are hereby repealed.
