Judge sums up Selebi case

The defence limited their attacks to the credibility of only two main witnesses in former Police Commissioner Jackie Selebi's corruption trial, Judge Meyer Joffe said on Thursday.


They had concentrated on Glenn Agliotti and his former fianceé Dianne Muller, which was "not good".

In handing down his judgment in the High Court in Johannesburg, Joffe said that in order for the court to make a decision the State had to prove its case beyond a reasonable doubt and that both Agliotti and Selebi's versions had to be thoroughly analysed.


The test remained that the defence's evidence may be substantially true and the accused may be innocent.

"That's why the impression of witnesses is important and the court had to apply its mind to... the credibility of witnesses, the reliability and the probability," said Joffe.


He said that if the court finds the accused's version reasonably true, that is grounds for an acquittal.


Joffe said that he thoroughly analysed contradictions in evidence, probability or improbability of specific aspects of Agliotti and Selebi's versions, and the quality and independence of the witnesses' versions.


The case adjourned to 9.30am on Friday for continuation of judgment.


Joffe had earlier spoken about gifts given to Selebi by Agliotti as he painted a picture of the relationship between the two to determine who was telling the truth.


Agliotti had testified that he and the accused would go shopping in Sandton and meet for coffee.


Agliotti testified that he bought two pairs of shoes for Selebi and items from London as well as clothing for his family.


He said Agliotti claimed to have bought a Gucci bag for Selebi's wife Anne and that he had provided receipts of purchases he had made from a Sandton shopping centre.


Agliotti said that he had bought Selebi's sons Fubu items from Sandton but Selebi's version was that he did not wear Fubu and neither did his children.


The two versions were completely different, Joffe said.
