The Constitution Seventeenth Amendment Bill (“the Bill”) seeks to provide that the Constitutional Court (“CC”) be the highest court in all matters and further, regulate the jurisdiction of the CC and Supreme Court of Appeal (“SCA”). This would result in the CC becoming the apex court of South Africa.
