The Freedom Front Plus can, following consultations with its senior legal team, announce that the class action and claim of Transnet pensioners against Transnet will be launched within the next two to three weeks. The civil claim against Transnet is made up of two parts, i.e. the application to the High Court requesting permission to bring a class action and following on this, the core claim that Transnet supplements the two pension funds, that of the Transnet Second Defined Benefit Fund (TSDBF) and the Transport Pension Fund (TPF) as prescribed by the parliamentary order. “There is also a claim that Transnet undertakes further funding of the Transnet pension funds should it appear that the R1,9 billion which is payable in terms of the parliamentary order, is insufficient to see to the needs of the pensioners,” adv. Alberts, the FF Plus’ parliamentary spokesperson on economic affairs, said.
It can also be announced that, apart from senior counsel, adv. Jaap Cilliers, who will be handling the class action, two more senior advocates have joined the legal team. One of these two counsellors is advocate Leon Kellerman, an expert on pension funds who is at present also working on the existing Pension Fund Act. The team believes that the pensioners have a very good chance of success and is looking forward to forcing Transnet to fulfil its obligations toward its previous employees.
