[1] The respondent is the registered owner of certain immovable property (‘the property’) measuring 2 023m² and situated at 62 Glenugie Road, Manors, Pinetown, KwaZulu-Natal.


[2] The applicant, the Ethekweni Municipality, seeks an order that the respondent be interdicted and restrained from using the property in contravention of the Pinetown Town Planning Scheme in the course of preparation (‘the Town Planning Scheme’) and the provisions of the National Building Regulations and Building Standards Act, 1977 (‘the NBR’). The applicant further seeks an order that the respondent be directed to demolish a generator room, and a wooden hut comprising offices, which are located on the property. It also seeks an interdict restraining the respondent from occupying any portion of those buildings in the absence of plans approved by the applicant.
