The Land and Agricultural Development Bank Act (the Land Bank Act) allows the Minister of Finance to appoint members to the Land Bank board and limits parliament's involvement in the appointment process to merely acting as a post office for receiving nominations. This procedure does not allow for proper oversight by parliament. In fact it is unclear what parliament's specific role in the process should be. The correct procedure that should be followed when board members are appointed is that nominations are called for and received by the Minister. The relevant parliamentary committee then evaluates the nominations and interviews the prospective candidates, after which a preferential list is drawn up which is presented to the Minister which allows the minister to appoint the members. The Democratic Alliance (DA) has dedicated itself to ensuring Parliament becomes a centre of excellence that holds the executive to account. One of parliament's most important roles is to exercise scrutiny and oversight over the executive in order to promote the constitutional values of accountability and good governance. It is imperative that parliament is involved when nominations are tabled to ensure that the executive can be held accountable. In the portfolio committee meeting, the DA proposed (and it was agreed to) that the committee in its report requests the minister to involve it in such a way as to enable it to evaluate, select and interview candidates and thereafter propose a shortlist to the minister. The DA will further explore the possibility of introducing a private members bill to amend the Act to allow for proper involvement and oversight by parliament.
