The Democratic Alliance (DA) is delighted at the decision by the National Prosecuting Authority (NPA) not to appeal the judgment of the Supreme Court of Appeal (SCA) in favour of the DA with regard to the discontinuation of the prosecution against Jacob Zuma. This will now allow the review proceedings to go ahead in the Gauteng North High Court and will prevent any further delays in the matter, which has already dragged on since early 2009.

The party will now await the reduced record of the NPA’s decision and will, with its lawyers, study the record. Depending on the nature of the documentation we receive, we will brief our legal team to proceed with the substantive review of this decision, with the objective of determining before a court of law whether the decision to discontinue the prosecution against Jacob Zuma was based on rational defensible legal grounds, or whether it was in fact a political decision.
