The Democratic Alliance (DA) welcomes today’s decision by the Judicial Service Commission (JSC) that it will conduct an open interview of Justice Mogoeng Mogoeng on the 3rd of September. The DA called for an open and public interview process after the President announced his nominee for Chief Justice last week.
The Constitution envisages a meaningful consultation between the President, the JSC and the leaders of political parties. For the process to be meaningful, the JSC must have an opportunity to interview the President’s nominee. This will also allow an opportunity for Justice Mogoeng to respond directly to some of the concerns that have been raised about his nomination by members of the legal and academic fraternity.
The DA has not expressed any view whatsoever on Judge Mogoeng’s nomination and will do so only when DA leader Helen Zille gives President Zuma her considered reply to his invitation to comment on Judge Mogoeng’s suitability for the Chief Justiceship, and after the JSC has had an opportunity to interview the nominee.
