Satawu leadership led about five hundred (500) of its shopstewards in Gauteng to World net, a German owned company which operates in Gauteng, Western Cape and Kwazulu Natal.
Satawu is trying to cure the ulcer it has as a result of the alleged racist attitude and arrogance by the company's managing director by the name of Joachim Bade. This honorable gentleman allegedly told workers whom he employed that he is not in South Africa to "enrich Blacks" but to do business. The union has been caught by surprise by statements of this nature as it was not expecting that there are still people who still live in the past.
Satawu memorandum mainly focused on the refusal by the employer to grant the union organizational rights after every attempt has been done to resolve the issue amicably with the employer and workers resorted to strike. An attempt by the CCMA to call the parties for mediation / or an intervention in terms of section 150 of the labour relations act 66 of 1995 as amended drew a blank as the employer refused to be part of the process.
The memorandum called upon the employer to:
1. Meet with Satawu to deal with the recognition of the union.
2. To agree with the union about the rights to be accorded the union
3. The employer to register itself and provide the necessary information to the National Bargaining Council for Roadfreight Industry.
Satawu will wait until closure of business on Monday (12 / 10 / 2009) for a response as promised by the company management when they accepted the memorandum. Failure to respond the following programme of action will be implemented.
1. Letters will be sent to all the World net clients informing them about the danger of doing business with this company.
2. Mobilize all the branches that are organized by this company for a secondary strike.
3. Communication Workers Union in the Province will be approached to assist for a secondary strike as most of the clients of this company are within the scope of communication since it is a Courier company specializing with the delivery of communication material.
4. The Labour Brokers that operate in the Company will be targeted for them to stop the service they are currently providing to this company, more over that they are themselves in our list as we are to fight against the existence of the same Labour Brokers.
5. Already the head office of Satawu has been advised to contact ITF (International Trade Federation) for an action as we are informed that this is an International Conglomerate.
6. The Human Rights Commission will be contacted on Monday to about the racial discrimination allegations by the workers and a case against the company will be opened at CCMA after Conciliation it will be referred to the Labour Court for Racial discrimination. This will take course irrespective of the fact that the dispute about organizational rights is resolved as we cannot tolerate any acts of racism in our Country.
7. The National Bargaining Council for Roadfreight Industry will be assisted with the relevant information at our disposal about the company and encouraged to continue with the inspection process.
8. The worker who was intentionally hit by a truck by a company transport manager (Mack Hooner) for refusing to leave the picket point will be assisted by all means possible by Satawu and when this beast (Mack Hooner) appears in Kemptonpark magistrate Court on 22 / 10 / 2009 Satawu will be there to give solidarity to the worker.
