COSATU notes the Supreme Court of Appeals ruling 28 September 2011 which holds trade unions liable for damage caused during strikes.
The federation will study the judgment as well as its legal implications and issue its comment thereafter.
Whilst COSATU does not condone violence and damage to property that occurs during some strikes, we will challenge any ruling that seeks to pass the liability for the violent actions of a few individuals and agent provocateurs on the shoulders trade unions. Should this be the implication contained in the judgment, the federation will have no other choice but to take this matter up with the Constitutional Court.
COSATU reaffirms its commitment to peaceful strikes and the responsibility to ensure that our marshalling system plays its role in maintaining strike actions peaceful and orderly.
