COSATU accepts the appointment of Justice Mogoeng as Chief Justice as the outcome of a process prescribed in South Africa’s constitution.
As COSATU we registered our reservations about Justice Mogoeng as a candidate for Chief Justice. Our reservations were motivated by a strong belief that judicial transformation is an integral part of the transformation of the country.
We are content that history will record that COSATU stood firm on its principles when opposing Justice Mogoeng’s candidacy for Chief Justice.
We trust that the Chief Justice will consider the issues we raised in our submission to the JSC, particularly around gender-based violence and rape and hope to work together with the Justice Mogoeng in the struggle for the realization of the progressive values enshrined in the country’s constitution.

COSATU will continue to struggle for a judiciary that is responsive to the social and economic environment in South Africa where there exists a reality of mass unemployment, poverty, inequality and unsettling levels of gender based violence.
