The Congress of the People is deeply concerned about the finding of the JSC in the matter of the alleged behaviour of Judge John Hlope.
Like the fixing of the case against the now State President, this decision looks like a political deal and not a finding based on the evidence. Judge Hlope's excuse, that he did know it was wrong to discuss the case pending against the President, calls into question his suitability as a judge, let alone his nomination to the Constitutional Court.
In the light of the questions that remain with regard to this matter, COPE supports the call for a full inquiry to consider Judge Hlope's conduct. In the interim, the Judge should remain on leave.
The slow but steady war of attrition on our democratic institutions must be halted. This matter must be seen to be properly dealt with.
