The judges will reveal their view on whether Ivan Toms' 1999 appointment as director of health in the Cape Town unicity was wrong in terms of the Employment Equity Act.
Toms is a white man.
His rival for the job - the woman who brought the matter to court - Lilian Dudley, is a coloured woman.
Dudley contended that she should have got the job as an ideal affirmative action candidate – Sapa.
