For the first time a court has confirmed that, under the new Companies Act, private companies are obliged to provide members of the public and journalists with their securities/shares registers. This is the only way to obtain ownership information of private entities, as these are not held by the CIPC. The court further held that it was criminal for companies to withhold the information from the public.
