This is an application for leave to appeal against the judgment of the Supreme Court of Appeal1 in terms of which an order granted by the Labour Appeal Court2 was set aside. The case served before the Labour Appeal Court as an appeal against the judgment of the Labour Court3 in which an application by Aviation Union of South Africa (Aviation Union) was dismissed.
