The ANC is disappointed by the ruling of the
North Gauteng High Court, yesterday evening (1 April 2010) that the ANC YL
President, Julius Malema must temporarily refrain from singing the part
‘Dubula ibhunu' in the struggle song ‘Ayesaba Amagwala'.
Our disappointment
is based on the fact that the Judge did not consider the historical context,
and the purpose of the song. The Judge only considered the literal meaning
of the words ‘Dubula ibhunu'.
The ANC will concentrate its efforts in
challenging the application by AfriForum at the Equality Court were the
forum seeks the court to declare some part of the song as hate speech.
On
the same vain, the ANC is approaching our Courts, inclusive of the
Constitutional Court to get the correct interpretation of the historical
meaning, the historical context, the usage and purpose of our struggle songs
inclusive of ‘Ayesaba amagwala'. This will be done with an intention of
reversing the South Gauteng High Court recent judgement which found that
certain parts of the struggle song ‘Ayesaba amagwala' is unconstitutional.
