In claim A the applicant seeks relief arising from his alleged automatically unfair dismissal on the grounds of his HIV status in terms of section 187(1)(f) of the Labour Relations Act, 66 of 1995 (“the LRA”). In the alternative, the applicant pleads that his dismissal was substantively and procedurally unfair in terms of section 188 of the LRA. In claim B he seeks relief arising from unfair discrimination on the grounds of his HIV status as proscribed by section 6(1) read with section 50(2)(b) of the Employment Equity Act, 55 of 1998 (“the EEA”).
