At once stage the department issued a directive in terms of the Environment Conservation Act in an attempt to force Vesuvius to close down.
However, the firm made a successful appeal.
On March 6, 2003, the department issued another directive instructing Vesuvius to comply with the registration certificate by March 2004.
It then emerged that the company needed more time to comply, which was granted.
Following negotiation, a compromise was reached whereby the affected parties undertook not to take any further actions against Vesuvius until the end of March 2004.
The MoA therefore required Vesuvius to undertake to install abatement equipment in respect of all its kilns by March 2004, failing which they will close down.
