AfriForum: Statement by Willie Spies, AfriForum Legal Representative, asserting that ANC has to pay costs of Appeal Court postponement (03/09/2012)

The Supreme Court of Appeal earlier today indefinitely postponed an application by the ANC to appeal against the ruling of acting judge Leon Halgryn, regarding the controversial “Shoot the Boer”-song of expelled ANC Youth leader, Julius Malema. The court also ordered the ANC to cover the costs of the postponement.

AfriForum’s legal representative, Willie Spies welcomed the court’s decision to punish the ANC with a cost order.

The ANC intended to appeal against the ruling of acting judge Halgryn, who refused the ANC to join the court case as an intervening party. A court order was earlier granted in a dispute between mr Mohamed Vawda and Mr Willem Harmse whereby it was ruled that the words “dubula iBhunu” (Shoot the Boer/white man) are unconstitutional and incitement to murder.

Appeal court judge, Kenneth Mthiyane ordered the ANC to pay the costs of the postponement. The ANC asked for the postponement, as AfriForum’s hate speech case against Malema will be heard in the Supreme Court of Appeal later this year. Malema sang the controversial song at several events.
