AfriForum: Statement by Willie Spies, AfriForum Legal Representative, on High Court rejecting Motata's application (07/09/2012)

The North Gauteng High Court delivered judgement in the controversial Judge Nkola Motata’s application to be permitted to again act as judge pending a disciplinary hearing by the Judicial Service Commission that’s underway.
Judge Motata’s application was brought against the Minister of Justice, the Judicial Service Commission and civil rights organisation, AfriForum. These parties opposed the application.
A Judge from the Eastern Cape division of the High Court, Judge Jean Nepgen was called in to hear the application, as Judge Motata is a judge in the North Gauteng division of the High Court.
Willie Spies, AfriForum’s legal representative said that AfriForum welcomes the judgement of Judge Nepgen, as AfriForum firmly believes that Judge Motata is incompetent to act as judge, after he was convicted of drunk driving following an incident in which he made harsh racist utterances against police officers and members of the public.
It is expected that a tribunal of the Judicial Service Commission will soon continue the disciplinary hearing against Judge Motata.
