The Protection of State Information Bill (POSIB) was adopted, with significant amendments, by the National Council of Provinces (NCOP) on 29 November 2012, and referred to the National Assembly for consideration of those amendments.

On 26 April 2013 the National Assembly accepted all changes proposed by the NCOP and formally adopted POSIB. It was thereafter referred to the President for signature.

During this interim period the President's legal advisors are reported to be considering the constitutionality of POSIB.
