[1] On 18 August 2009 the plaintiff sued the defendants for unlawful arrest, unlawful detention and contumelia for a sum of R300 000.00. [2] The plaintiff’s case is that on 15 January 2009 he was arrested by the second defendant at Sterkspruit on charges of driving a motor vehicle without a valid driver’s licence. The second defendant alleged that the plaintiff was under influence of liquor and he detained him from about 11h00 to 20h00, so as to gain sobriety.
