The plaintiff has instituted action against the first and second defendants for damages in the sum of R3 788 762,64 for loss of profit. The plaintiff claims that it suffered such loss due to the failure of the Department of Education, Eastern Cape, (‘the Department’) to award the plaintiff a contract, or any part thereof, pursuant to a tender advertised by the Department.
