Decision to withdraw from ICC in breach of Constitution

A campaign by Save South Africa has been flooded with messages of support since making a call for a people’s assembly to discuss state capture.

South Africans have been offering to help the campaign’s demonstrations against state capture in November, one of its steering committee members, Lawson Naidoo, said on Monday.

The protests will take place as Finance Minister Pravin Gordhan, former South African Revenue Service commissioner Oupa Magashula and former deputy commissioner Ivan Pillay appear in the Pretoria Regional Court.

Cabinet's decision to withdraw from the International Criminal Court is in breach of the Constitution, the Democratic Alliance has argued in court papers.

Justice Minister Michael Masutha said on Friday that the government's reason for removing itself as a signatory of the Rome Statute was because it conflicted with its obligations to the African Union to grant immunity to its heads of states.

Parliament needed to take a decision to repeal the Implementation Act of 2002 before being able to vote on withdrawing from the ICC.

Justice Minister Michael Masutha has announced that a proposed bill to combat hate crimes and hate speech has been opened for public debate and consultation.

Masutha addressed the media in Pretoria on Monday and said the Prevention and Combating of Hate Crimes and Hate Speech Bill would criminalise acts of hate speech.

Masutha said nationality, gender identity, HIV status, albinism, intersex, and occupation or trade were not mentioned in the Constitution, but were included in the bill because of previous hate crimes that had been committed on those grounds.

The bill was drafted after thorough study of similar legislation in Kenya, Canada and Australia.
