Exclusivity clauses contained commercial property lease agreements are increasingly being scrutinised by the competition authorities.

Exclusivity clauses in leases generally restrict a landlord's freedom to let other units in its building. This restriction might be framed by reference to a type of tenant (for instance, the landlord might promise not to let any other units in its shopping centre to direct competitors of a current tenant) or by reference to a number of named companies (usually competitors of the tenant in question).
