LOCAL GOVERNMENT: MUNICIPAL SYSTEMS REGULATIONS, 2001

Under section 120 of the Local Government: Municipal Systems Act, 2000 (Act No. 32 of 2000), I, Fholisani Sydney Mufamadi, after consultation with organised local government representing local government nationally, hereby make the regulations in the Schedule.

SCHEDULE

Definitions

  1. In these regulations a word or phrase to which a meaning has been assigned in the Local Government: Municipal Systems Act, 2000 (Act No. 32 of 2000), has that meaning and, unless the context otherwise indicates

"the Act" means the Local Government: Municipal Systems Act, 2000;

Prescribed periods

  1. The prescribed period referred to in-
  1. section 25(1) of the Act is 15 months and 26 days (i.e. by 31 March 2002);
  2. section 27(1) of the Act is seven months and 10 days (i.e. by 16 July 2001); and
  3. section 28(1) of the Act is seven months and 10 days (i.e. by 16 July 2001).

Prescribed amount of gifts received by councillor

  1. (1) Gifts received by a councillor must be declared in terms of item 7(1) of Schedule 1 to the Act where-
  1. the value of a gift exceeds 81000; and
  2. the value of gifts received from a single source in any calendar year exceeds R 1000.

(2) A declaration of gifts received by a councillor must

  1. contain a description of such gift or gifts, as the case may be; and
  2. indicate the value and source of such gift or gifts, as the case may be.

Short title and Repeal of Regulations

  1. (1) The Local Government: Municipal Systems Regulations, 2001, Government Notice No. 135, published in Government Gazette No. 22056 of 9 February 2001, are hereby repealed.

(2) These regulations are called the Local Government: Municipal Systems Regulations, 2001, and take effect on the date of publication hereof.
