NATIONAL ROAD TRAFFIC ACT, 1996 (ACT NO. 93 OF 1996)

AMENDMENT OF THE NATIONAL ROAD TRAFFIC REGULATIONS

The Minister of Transport has under section 75 of the National Road Traffic Act, 1996 (Act No. 93 of 1996), made the regulations in the Schedule.

SCHEDULE

Definition

  1. In this Schedule "the Regulations" means the National Road Traffic Regulations published in Government Notice No. R. 225 of 17 March 2000, as amended by Government Notice No. R. 761 of 31 July 2000.

Amendment of regulation 308A of the Regulations

  1. Regulation 308A of the Regulations is amended by the substitution in subregulation (3) for paragraph (b) of the following paragraph:

"(b) the phrases "cellular or mobile telephone or any other communication device" and "cellular or mobile telephone or other communication device", excludes land mobile radio transmission and reception equipment operating in the frequency band 2 megahertz to 500 megahertz that is affixed to the vehicle or is part of the fixture in the vehicle.".

Insertion of regulation 343C in the Regulations

  1. (1) WHEREAS section 93(1) of the National Road Traffic Act, 1996 (Act No. 93 of 1996), whereby the Road Traffic Act, 1989 (Act No. 29 of 1989) is repealed, came into operation on 1August 2000;

AND WHEREAS the first named Act does not make provision for a transitional provision concerning a resolution or by-law made, or the establishment of ranks or stands, by local authorities;

AND WHEREAS it is desirable to validate such resolutions, by-laws and establishments retrospectively in terms of section 75(1)(zA) and (2A) of the first named Act:

(2) . The Regulations is amended by the insertion after regulation 3438 of the following regulation:

"Transitional provision: Validation of things done by local authorities

343C. Any resolution and by-law made, and any establishment of ranks or stands, by a local authority in terms of the Road Traffic Act, 1989 (Act No. 29 of 1989) that would have been valid if the Act did not come into operation, is hereby validated up and until a date determined in any road traffic law that makes provision for such resolution, by-law or establishment of ranks or stands, and shall from that date be dealt with in the manner prescribed in such law.".

Short title

  1. These regulations are called the Second Amendment of the National Road Traffic Regulations.
