NATIONAL ROAD TRAFFIC ACT, 1996 (ACT NO. 93 of 1996)
AMENDMENT of THE NATIONAL ROAD TRAFFIC REGULATIONS
The Minister of Transport has under section 75 of the National Road Traffic Act, 1996 (Act No. 93 of 1996), made the regulations in the Schedule.
SCHEDULE
Definition
In this Schedule "the Regulations" means the National Road Traffic Regulations published in Government Notice No. 225 of 17 March 2000.
Amendment of regulation 247 of the Regulations
Regulation 247 of the Regulations is amended by the deletion of the proviso.
Amendment of regulation 308A of the Regulations
Regulation 308A of the Regulations is amended by the substitution for subregulation (3)of the following subregulation:
"(3) For the purpose of this regulation-
the word "headgear" includes for the purpose of this regulation a device which is specially designed or adapted to allow the driver to use a cellular or mobile telephone or the communication device in such a manner that he or she does not hold it in one or both hands or with any other part of the body, and which is connected to the cellular or mobile telephone or other communication device concerned, directly or indirectly, while being fitted to or attached to one or both ears of the driver; and
for a period of 12 months from the date of coming into operation of this regulation, the phrases "cellular or mobile telephone or the communication device" and "cellular or mobile telephone or other communication device", excludes land mobile radio transmission and reception equipment operating in the frequency bandwidth 2 megahertz to 500 megahertz.".
Insertion of regulation 343B in the Regulations
The following regulations is inserted after regulation343A
"Transitional provisions: Exemption from laws relating to parking
343B. A valid exemption certificate issued under section 137 of the Road Traffic Act, 1989 (Act No. 29 of 1989), shall remain valid up until a date determined in a provincial law that makes provision for such a exemption certificate, and shall from that date be dealt with in the manner prescribed in such provincial law.".
Title and commencement
These regulations are called the First Amendment to the National Road Traffic Regulations, and come into operation on 1 August 2000.
