BASIC CONDITIONS OF EMPLOYMENT ACT, 1997 (ACT No. 75 OF 1997)

EMPLOYMENT CONDITIONS COMMISSION INVESTIGATION INTO THE HOSPITALITY SECTOR, SOUTH AFRICA

In terms of section 52 read with section 53 of the Basic Conditions of Employment Act, 1997, I, Membatshisi Mphumzi Shepherd Mdladlana, Minister of Labour, hereby direct the Director-General to investigate the conditions of employment and wages in the Hospitality Industry in the Republic of South Africa.

The terms of reference of the investigation shall be as follows:

To investigate conditions of employment and the rate of remuneration in respect of all classes of employees in the Hospitality Sector in the Republic of South Africa.

In the application of this terms of reference, Hospitality Sector, means any business that are associated with the following activities:

  1. hotels and restaurants, including hotels, motels, resorts and game lodges, hostels, guest houses, guest farms and bed-&-breakfasts;
  2. provisions of short-stay accommodation, including short-term rentals, self-catering or time shares, camps and caravan parks;
  3. restaurants, bars canteens and other catering services, including food preparation, food and beverage services, licensed clubs and fine dining establishments; pubs and taverns; fast food outlets, snack bars and kiosks; industrial and contract caterers; function and outside caterers;
  4. travel agencies, tour operators and related activities, including retail and general travel operations; tourism marketing and development agencies and companies; tourism authorities, commissions and boards; tourist information canters; tourism industry associations;
  5. destination management; including tour operators and guides; venue management; museums; special attractions, management of special events, conventions, exhibitions and festivals; event, conference, festival and attraction venue management; fun fairs and parks; rafting; abseiling, hang-gliding, bungeejump and other adventure tourism operations;
  6. motor car rental services;
  7. conservation, game parks and zoological establishments, including wildlife conservation, wildlife parks and game reserves; camp and conservation park management; trekking and safari operators; botanical gardens;
  8. gaming and gambling, including casinos and other table, electronic and slot machine gaming outlets; clubs; gambling, betting and bookmaking operators; totalisators; lottery operations; horse racing clubs; and
  9. inbound international airline operators.

I give notice in terms of section 52 (3) of the Basic Conditions of Employment Act, 1997, of the commencement of said investigation and invite written representations by interested persons. Such representations should reach the Directorate: Minimum Standards, Department of Labour, Private Bag X117, Pretoria, within 60 days of the publication of this notice.
