AVIATION ACT 1962 PROPOSED AMENDMENT OF THE CIVIL AVIATION REGULATIONS

Under Regulation 11.03.2 (1) (a) of the Civil Aviation Regulations, the Chairperson of the Regulations Committee hereby published for comment the proposed amendments to the Civil Aviation Regulations, 1997, as set out in the Schedules. SCHEDULE 1

  1. PROPOSALS FOR THE AMENDMENT OF REGULATION 11.02.2 (MEETINGS OF THE COMMITTEE) 11.03.2 PROCESSING OF PROPOSAL) AND 11.03.3 (CONSIDERATION OF PROPOSAL)

EXPLANATION OF INTEREST OF THE PROPOSER

Proposer is an active participant within the aviation sector.

1.1(1) PROPOSED AMENDMENT OF REGULATION 11.02.2 (INSERTION OF SUBREGULATION (6) )

" A register shall be kept of all members at a committee meeting and statistics compiled. Such statistics shall be published from time to time but at least quarterly in the media contemplated in 11.03.2.1 d"

1.2(1) MOTIVATION

Public interests are represented at CARCOM by various organisations. Such groups need to monitor their delegate's performance to ensure that their interests are adequately catered for.

1.3.(1) CURRENT REGULATION

No current regulation exists.

1.1.(2) PROPOSED AMENDMENT OF REGULATION 11.03.2(1) (INSERTION OF PARAGRAPHS (c) to (e))

"(d) Publish the proposed regulation, amendment or withdrawal for distribution by regular mail to subscribers at a fee;
(d) Where comments received in terms of 11.03.2.2 are considered significant these comments may be republished in terms of 11.03.2 along with the original proposal, withdrawal or amendment. The chairperson may edit these comments to include only such comments that are deemed significant; and
(e) Publish by other available cost-effective means the proposed regulation, amendment or withdrawal. Such means includes but is not limited to Internet and electronic mail".

1.2.(2) MOTIVATION

The current CARCOM process is perceived by end users to be prescriptive, non-inclusive and resulting in low quality of final legislation. Improvement of communication within the aviation sector will help alleviate this perception, stimulate interest in the process and improve the quality of the finished product. CAA has already implemented most of the procedure. Media contemplated in 11.03.2.(1)( d) is very cost effective.

1.3(2) CURRENT REGULATION

No current regulation exists.

1.1(3) PROPOSED AMENDMENT OF REGULATION 11.03.3 (INSERTION OF SUBREGULATIONS (3) AND (4))

"(3) Where a member of the committee objects to a proposed regulation, amendment or withdrawal and the proposed regulation, amendment or withdrawal is in any event passed to the Commissioner for approval such proposed regulation amendment shall be endorsed with the name(s) of the objector(s) and reasons for such objection (s). A list of approved additions amendments, or withdrawals along with any objectors to such additions, amendments, or withdrawals shall be maintained and published from time to time but at least quarterly. Publication media for such list will be the AIC and those media contemplated in 11.03.2.1d" .

"(4) Where a member of a committee supports a proposed regulation, amendment or withdrawal and the proposed regulation amendment or withdrawal is in any event rejected by the committee such proposed regulation amendment shall be endorsed with the name(s)of the objector(s) and reasons for such objection(s). A list of rejected additions, amendments, or withdrawals along with any objectors to the rejection of such additions, amendments or withdrawals shall be maintained and published from time to time but at least quarterly. Publication media for such list will be the AIC and those media contemplated in 11.03.2.1d".

1.2(3) MOTIVATION

Part 11 does not require decision-making. Where legislation is enacted that is harmful tot he industry, a sector of the industry or the public interest end users need to identify which groups opposed such legislation. Performance monitoring of this type will ensure delegates who are truly representative of their interest groups.

Proposers may exert considerable effort in the research and development of proposals that are ultimately rejected by the committee. Such proposers need know who's interest to consider when submitting similar proposals.

The Commissioner and Minister at present perform a "rubber stamping" function when approving regulations. A study of a regulation's endorsement will empower these people to make a better-informed decisions.

1.3(3)CURRENT REGULATION

No current provisions exist.

  1. PROPOSAL FOR AMENDMENT OF REGULATION 67.00.6 (PERIOD OF VALIDITY OF MEDICAL CERTIFICATES)

EXPLANATION OF INTEREST OF THE PROPOSER

The Authority is responsible for the administration of the Aviation Act, 1962 (Act No 74 of 1962) and regulations issued in terms thereof.

2.1 PROPOSED AMENDMENT OF REGULATION 67.00.6(INSERTION OF SUBREGULATION (5)):

"(5) The period of currency shall begin on the date that the medical certificate is issued for the period as specified in subregulations (1), (2) and (3)."

2.2 MOTIVATION

The present regulation does not state clearly the date from which the certificate is deemed to be valid.

ICAO clearly states in Annex 1, paragraph 1.2.4.2 as follows: "The duration of the period of a Medical Assessment shall be in accordance with the provision of 1.2.5. The period of currency shall begin on the date the Medical Assessment is issued."

2.3 CURRENT REGULATION

(1) A Class I medical certificate shall be issued for a period not exceeding -

  1. 12 calendar months, calculated from the last day of the calendar month in which the medical certificate is issued, ................
  2. six calendar months in calculated from the last day of the calendar month in which the medical certificate is issued ..............

(2) A Class 2 and 3 medical certificate shall be issued for a period not exceeding -

  1. 24 calendar months, calculated from the last day of the calendar month in which the medical certificate is issued ............
  2. 12 calendar months, calculated from the last day of the calendar month in which the medical certificate is issued .............

(3) A Class 4 medical certificate shall be issued for a period not exceeding -

  1. 60 calendar months, calculated from the last day of the calendar month in which the medical certificate is issued .............
  2. 36 calendar months, calculated from the last day of the calendar month in which the medical certificate is issued ............

2.4 PROPOSED AMENDMENT OF REGULATION 67.00.6 (b) AND PROPOSED INSERTION OF REGULATION 67.00.6 (c) CONTAINED IN THE NINTH AMENDMENT OF THE REGULATIONS SUBMITTED TO THE DEPARTMENT OF TRANSPORT.

"(b) six calendar months in the case of an airline transport pilot (aeroplane) or (helicopter) calculated from the last day of the calendar month in which the medical certificate is issued;

(c) six calendar months in the case of a commercial pilot (aeroplane) or (helicopter), a commercial microlight aeroplane pilot, a gyroplane pilot for commercial purposes, commercial glider pilot, an airship pilot for commercial purposes, a free balloon pilot for commercial purposes or a powered paraglider pilot for commercial purposes, calculated from the last day of the calendar month in which the medical certificate is issued..."

  1. PROPOSAL FOR THE AMENDMENT OF REGULATION 91.02.1 (COMPOSITION OF FLIGHT CREW)

EXPLANATION OF INTEREST OF THE PROPOSER

The Authority is responsible for the administration of the Aviation Act, 1962 (Act No 74 of 1962) and regulations issued in terms thereof.

3.1 PROPOSED AMENDMENT OF REGULATION 91.02.1 (3)

"(3) The flight crew shall include at least one member who holds a valid radiotelephony operator licence or an equivalent document issued by an appropriate authority, authorising such member to operate the type of radio transmitting equipment to be used."

3.2 MOTIVATION

The spelling of the current regulation is incorrect and should be rectified.

3.3 CURRENT REGULATION:

"(3) The flight crew shall include at least one member who holds a valid radiotelephony operator licence or an equivalent document issued by an appropriate authority, authorising such member to operate the type of radio transmitting equipment to be used."

EXPLANATION OF INTEREST OF THE PROPOSAL

The Authority is responsible for the administration of the Aviation Act, 1962 (Act No 74 of 1962) and regulations issued in terms thereof.

4.1 PROPOSED AMENDMENT OF REGULATION 121.01.1 (paragraphs (a) and (b))

"Applicability

(1) This part shall apply to -

  1. aeroplanes with a maximum certified mass exceeding 5700 kilograms, and a maximum CAA approved passenger seating configuration of more than nine seats, engaged in commercial air transport within the Republic;
  2. aeroplanes with a maximum certified mass exceeding 5700 kilograms, and a maximum CAA approved passengers seating configuration of more than nine seats, registered in the Republic, but engaged in commercial international air transport operations;"

4.2 MOTIVATION:

The current legislation creates confusion among commercial operators and allows for the possibility of incorrect reading and interpretation of the existing regulation.

4.3 CURRENT REGULATION

"Applicability

(1) This part shall apply to -

  1. aeroplanes with a maximum certified mass exceeding 5700 kilograms, or a maximum approved passenger seating configuration of more than nine seats, engaged in commercial air transport within the Republic;
  2. aeroplanes with a maximum certified mass exceeding 5700 kilograms, or a maximum approved passengers seating configuration of more than nine seats, registered in the Republic, but engaged in commercial international air transport operations;"

  1. PROPOSAL FOR THE AMENDMENT OF REGULATION 135.01.1( APPLICABILITY -AIR TRANSPORT OPERATIONS - SMALL AEROPLANES)

The Authority is responsible for the administration of the Aviation Act, 1962 (Act No 74 of 1962) and regulations issued in terms thereof.

5.1 PROPOSED AMENDMENT OF REGULATION 135.01.1

"Applicability

(1) This part shall apply to -

  1. aeroplanes with a maximum certified mass of 5700 kilograms or less, and a maximum CAA approved passenger seating configuration of not more than nine seats, engaged in commercial air transport within the Republic;
  2. aeroplanes with a maximum certified mass of 5700 kilograms or less, and a maximum CAA approved passenger seating configuration of not more than nine seats, registered in the Republic, but engaged in commercial international air transport operations;"

5.2 MOTIVATION:

  1. PROPOSAL FOR THE AMENDMENT OF REGULATION 138.03.2 (PILOT QUALIFICATIONS EMERGENCY MEDICAL SERVICE OPERATIONS)

EXPLANATION OF INTEREST OF THE PROPOSER

PROPOSAL SUBMITTED BY FOUCHEE JOUBERT AND COETZEE ON BEHALF OF THE PROPOSER

National Airways Corporation (Pty) Ltd is an air service licensed in terms of the Air Service Licensing Act, 1990 (Act No 115 of 1990) and the International Air Services Act, 1993 (Act No 60 of 1993).

National Airways Corporation (Pty) Ltd also provides a G7 type of air services, in accordance with the said legislation, referring specifically to "emergency medical service including the provision of casualty equipment and medical personnel"

6.1 PROPOSED AMENDMENT OF REGULATION 138.03.2

"The pilot of an aircraft engaged in an emergency medical services operation shall -

  1. in the case of a helicopter engaged in an emergency medical service operation, have completed not less that 1000 hours flight time as pilot-in -command of an aeroplane, of which not less than
  1. 5 hours shall be as pilot - in -command or at the controls of the type of helicopter operated; or
  2. 10 hours shall be as pilot in command at the controls of the helicopter, if the helicopter is the first multi-engine type helicopter to be flown by such pilot;..".

6.2 MOTIVATION

When reading paragraph (ii) of the regulation, it seems strange that a pilot with more than 2000 hours flight time only needs to have 10 hours on multi - engine type helicopters if it is a multi-engine helicopter used for the EMS flight.

Helicopter EMS flights are a day and VFR operation, therefore the 2000 hour flight time requirement seems extreme. Regulation 138.03.2 (c) is very restrictive in nature.

6.3 CURRENT REGULATION

"The pilot of an aircraft engaged in an emergency medical service operation shall -

  1. in the case of a helicopter engaged in an emergency medical service operation, have completed not less than 2000 hours flight time as pilot in command of an aeroplane, of which not less than -
  1. 5 hours shall be as pilot in command or at the controls of the type of helicopter operated; or
  2. 10 hours shall be as pilot in command at the controls of the helicopter, if the helicopter is the first multi-engine type helicopter to be flown by such pilot;...".

EXPLANATION OF INTEREST OF THE PROPOSER

The Authority administers the Aviation Act, 1962(Act No 74 of 1962) and regulations issued in terms thereof.

7.1.(1) PROPOSED AMENDMENT OF REGULATION 139.01.1(2)

"(2) No place in the Republic shall be used as a place of landing or departure by -

  1. aircraft used in aviation training except when operating under Parts, 98, 100, 101, 102, 103, 104, 105 and 106".

7.2.(1) MOTIVATION

The current regulation limits training for microlights, balloons, paragliders etc to be conducted on licensed aerodromes only and is not practical. This amendment will require only powered aircraft training to be conducted on a licensed aerodrome.

7.3.(1) CURRENT REGULATION

"(2) No place in the Republic shall be used as a place of landing or departure by

  1. aircraft used in aviation training unless it has been licensed in terms of the regulations in this Part".

7.1.(2) PROPOSED AMENDMENT OF REGULATION 139.01.28

"The Road Traffic Act, 1989 ( Act No 29 of 1989) and the Regulations issued in terms thereof, shall apply mutatis mutandis to all roads inside the restricted area of a licensed aerodrome or heliport as well as to all access roads to an aerodrome infrastructure".

7.2.(2) MOTIVATION

The current regulation only includes Chapter 7 of the Road Traffic Act. This excludes chapters dealing with other offences such as drunken driving. All traffic rules should be enforced and obeyed within aerodrome boundaries as this would result in more responsible driving habits of apron personnel.

7.3.(3) CURRENT REGULATION:

Chapter VII of the Road Traffic Act 1989 ( Act No 29 of 1989), shall apply mutatis mutandis to all roads inside the restricted area of a licensed aerodrome or heliport".

7.1(3) PROPOSED AMENDMENT OF REGULATION 139.02.3

"An applicant for the issuing of an aerodrome licence higher than Category 2, or for an aerodrome where scheduled commercial operations are to be conducted, shall provide the Commissioner with an operations manual which shall contain -
(a) ..... to .. (m) ....."

7.1(3) The requirements for operations manuals is found to be excessive for aerodromes less than category 2 where no training or scheduled passenger services are conducted. Most of such aerodromes are found to be either unmanned or corporate aerodromes with a single overseer. "Bush airstrips" are also found amongst this group and are currently not required to be licensed.

This relaxation will encourage more aerodromes to voluntary become licensed and thereby enabling the CAA to exercise control over safety standards applied in the game farm tourist industry - an industry which continues to transport high profile passengers, in small aircraft, into what can only be described as sometimes dangerous locations.

7.1.(3) CURRENT REGULATION

"An applicant for the issuing of an aerodrome licence shall provide Commissioner with an operation manual which shall contain -
(a) .... to.. (m) ...."

7.1.(4) PROPOSED AMENDMENT OF REGULATION 139.02.6(1)

"The applicant, who is required to submit an operations manuals under 139.02.3 shall establish an aerodrome emergency system designed to minimise the possibility and extent of personal injury and property damage on, or in the vicinity, of an aerodrome."

7.2.(4) MOTIVATION

The requirements for operations manuals is found to be excessive for aerodrome less than category 2 where no training or scheduled passenger services are conducted. Most of such aerodromes are found to be either unmanned or corporate aerodrome with a single overseer. "Bush airstrips" are also found amongst this group and are currently not required to be licensed.

7.2(5) MOTIVATION

The requirements for"all interested Government institutions" definitely includes the Department of Transport in all cases and the Department of Agriculture in cases where large pieces of land are to be used for airport development in rural areas. This amendment will eliminate some of the uncertainty surrounding this requirement.

It is recommended these regulations be created in advance of the writing of Part 136.
Part 136 will be known as:

Subpart (1) commercial operation of Free Balloons
Subpart (2) commercial operation of Airships.

11.3 CURRENT REGULATION

No such provision currently exists to cover fees related to Part 136.

  1. for the issuing of an initial Certificate of Approval in respect of Part 136 .................

12.2 MOTIVATION

No fee structure is currently available to cater to the requirements of commercial balloon operators.

No current regulations exist to cover fees related to Part 136.
