REGISTERS AND RECORDS

Matters relating to registers and records

331. (1) A registering authority shall retain records of all transactions executed by such registering authority as contemplated in section 77 of the Act.

(2) A testing station shall--

  1. keep record of--
  1. all applications in terms of regulation 139 made to such testing station;
  2. all tests and examinations conducted at such testing station;
  3. all certifications of roadworthiness issued by such testing station;
  1. summarize on a monthly basis, the results of all applications, examinations and testing conducted and provide copies of such summary to--
  1. the chief executive officer; and
  2. the inspectorate of testing stations; and
  1. reconcile on a monthly basis, the number of tests conducted, the number of tests passed, the number of certifications of roadworthiness issued and the stock of such certifications in the possession of such testing station and provide such reconciliation to the MEC concerned.

(3) A driving licence testing centre shall--

  1. keep record of--
  1. all applications in terms of regulation 103, 106 and 118 made to such testing centre;
  2. all tests and examinations conducted at such testing centre and the results thereof; and
  3. all licences and professional driving permits issued by such testing centre;
  4. all certificates of registration issued to instructors; and
  1. summarize, on a monthly basis, the results of all applications, examinations and tests conducted and of licences issued and provide copies of such summary to--
  1. the chief executive officer; and
  2. the inspectorate of driving licence testing centres.

(4) The chief executive officer shall--

  1. keep a register of--
  1. authorised officers;
  2. driving licence testing centres;
  3. testing stations;
  4. operators;
  5. manufacturers, builders and importers; and
  6. manufacturers of number plates.
  1. retain on a register referred to in paragraph (a), such information contained on any form completed in terms of the Act, as he or she may deem necessary for the purpose of the enforcement of the provisions of the Act.

(5) Final disposition of the records contemplated in this regulation shall be in accordance with the provisions of the National Archives of South Africa Act, 1996 (Act No. 43 of 1996).
