CROSS-BORDER ROAD TRANSPORT ACT, 1998 (ACT NO. 4 OF 1998)

AMENDMENT OF THE REGULATIONS IN TERMS OF SECTION 51 OF THE CROSS BORDER ROAD TRANSPORT ACT

The Minister of Transport has under section 51 of the Cross-border Road Transport Act, 1998 (Act No. 4 of 1998), made the regulations in the Schedule.

SCHEDULE

Definition

1. In the Schedule, unless the context otherwise indicates, the expression "the Regulations. means the Regulations in terms of section 51 of the Cross-Border Road Transport Act published by Government Notice No. R. 464 of 3 April 1998.

Amendment of Regulation 7 of the Regulations

2. Regulation 7 of the Regulations is hereby amended—

1. by the replacement of subregulation (2) with the following subregulation:

"(2) An application fee is payable to the Agency—

1. for a new application—

1. for a cabotage permit for a period of three months, six months or one year or for a fixed number of journeys, to the amount of R100, plus R100 for each trailer and semi-trailer;
2. for a temporary cabotage permit, to the amount of R100, plus R100 for each trailer and semi-trailer;
3. for a cross-border road transport permit for a period of three months, six months or one year or for a fixed number of journeys, authorizing the transport of freight or passengers or tourists, to the amount of R100;
4. for a temporary cross-border road transport permit authorizing the transport of freight or passengers or tourists, to the amount of R100;

2. for an application for renewal—

1. of a permit referred to in paragraph (a)(i), to the amount of R100, plus R100 for each trailer and semi-trailer;
2. of a cross-border permit for a period of three months, six months or one year or for a fixed number of journeys, authorizing the transport of passengers or tourists, to the amount of R300;
3. of a cross-border road transport permit for a period of three months, six months or one year or for a fixed number of joumeys, authorizing the transport of freight, to the amount of R100;

3. for an application for postponement of an application for renewal of a permit, to the amount of R100 per vehicle per month;
4. for an application for a duplicate permit, to the amount of R50; and
5. for an application for a replacement of a vehicle or particulars pertaining to the vehicle concerned, as reflected on the permit, to the amount of R50.".

2. by the replacement of subregulation (3) with the following subregulation:

"(3) After a permit, renewal of a permit, duplicate permit, or replacement of a vehicle or particulars pertaining to the vehicle concerned, as reflected on the permit, is granted, an issuing fee is payable to the Agency—

1. with respect to the issuance for the first time—

1. of a permit referred to in subregulation (2)(a)(i)—

27. for a period of three months, to the amount of R650, plus R650 for each trailer and semi-trailer;
54. for a period of six months, to the amount of R1 300, plus R1 300 for each trailer and semi-trailer;
81. for a period of one year, to the amount of R2 600, plus R2 600 for each trailer and semi-trailer;

2. of a permit referred to in subregulation (2)(a)(ii) for a period not exceeding 14 days, to the amount of R200, plus R200 for each trailer and semi-trailer;
3. of a permit referred to in subregulation (2)(a)(iii)-

27. for a period of three months, to the amount of R200;
54. for a period of six months, to the amount of R500;
81. for a period of one year, to the amount of R1 100;

4. in the case of a permit referred to in subregulation (2)(a)(iv), for a period not exceeding 14 days, to the amount of R100;

2. with respect to the issuance of renewal—

1. of a permit referred to in subregulation (2)(a)(i)—

27. for a period of three months, to the amount of R650, plus R650 for each trailer and semi-trailer;
54. for a period of six months, to the amount of R1 300, plus R1 300 for each trailer and semi-trailer;
81. for a period of one year, to the amount of R2 600, plus R2 600 for each trailer and semi-trailer;

2. of a permit referred to in subregulation (2)(a)(iii)—

27. for a period of three months, to the amount of R300;
54. for a period of six months, to the amount of R600;
81. for a period of one year, to the amount of R1 200;

3. with respect to the issuance of a duplicate permit, to the amount of R50; and
4. with respect to the issuance of a replacement of a vehicle or the particulars pertaining to the vehicle concerned, as reflected on the permit, to the amount of R50.".

Title and comneencernent

3. These regulations are called the Amendment of the Regulations in terms of Section 51 of the Cross-border Road Transport Act and shall come into operation upon the date of publication hereof.
