DEPARTMENT OF TRANSPORT

AVIATION ACT, 1962 (Act 74 of 1962)
FOURTH AMENDMENT OF THE CIVIL AVIATION REGULATIONS 1997

The Minister of Transport has under section 22 of the Aviation Act, 1962 (Act No 74 of 1962) made the regulations in the Schedule.

5 SCHEDULE

Definition:

  1. In these regulations, unless the context otherwise indicates "the Regulations" means the Civil Aviation Regulations, 1997, published by Government Notice Nos R.1219 of 26 September 1997 and R.1255 of 17 October 1997, as amended by Government Notice No R.1735 of 24 December 1997, Government Notice No. R1041 of 14 August 1998, Government Notice No R.1184 of 18 September 1998 and Government Notice No R. 1664 of 14 December 1998.

Amendment of Regulation 183.00.4 of Part 183 of the Regulations:

  1. Regulation 183.00.4 is hereby amended by the insertion of the following sub-regulations after sub-regulation (3):

(4) "Notwithstanding the provisions of sub-regulations (1), (2) and (3), Parts 61, 98, 100, 101, 102, 103, 104, 105, 106, 127, 133, 149 and Sub-Part 66.01.9 of the Regulations will not come into force on 31 December 1998, and will come into operation on a date to be determined by the Minister.

(5) Any reference in the Regulations to a Part or Sub-Part referred to in sub-regulation (4), shall be deemed to be a reference to the applicable section of the Air Navigation Regulations 1976 (as amended) and or The Rules of the Air, Air Traffic Services, Search and Rescue and Overflight Regulations 1975 (as amended), which sections, despite the provisions of Part 183.00.2 shall remain in force and effect until repealed by further notice issued by the Minister, except in so far as such a reference refers to fees payable, in which event the fees specified in Part 187 of the South African Civil Aviation Regulations will be applicable."

Short title and commencement:

  1. These regulations are called the Fourth Amendment of the Civil Aviation Regulations, 1997 and will come into operation on 31 December 1998.
