FILMS AND PUBLICATIONS ACT, 1996 (ACT NO. 65 OF 1996)

FILMS AND PUBLICATIONS REGULATIONS

The Film and Publication Board has, in terms of section 31 (2) of the Films and Publications Act, 1996 (Act No. 65 of 1996), made the regulations in the Schedule.

SCHEDULE

Amendment of Regulation 4 of the Films and Publications Regulations, 1998

  1. Regulation 4 of the Films and Publications Regulations, 1998, is hereby amended by the substitution for paragraphs (a), (b), (c) and (d) of the following paragraphs:

"(a) A submission of a film, including an advertisement or a trailer of a film, for classification in terms of section 18 of the Act shall be made to the Board on Form FPB 3/F, together with the applicable fee.

(b) Films shall be classified separately in the following formats: 35 mm, video, laser disc, compact disc and digital video disc (DVD). A separate classification shall be applied for in each of the said formats and a classification in one format shall not apply to a different format.

(c) An applicant for classification of a film in a particular format shall furnish, to the satisfaction of the Executive Committee of the Board, confirmation of her or hi. right to distribute and/or exhibit the film in that format in the Republic. In the absence of satisfactory confirmation of such distribution and/or exhibition rights, the Board may refuse to classify the film in that particular format and may revoke any certificate of classification which may have been issued with respect to that film in that format.

(d) Where the film, including an advertisement or trailer, is in a video or disc format, a copy of the video or disc must be submitted with the application.

(e) Where the film, including an advertisement or trailer, submitted is in a 35 mm format, the applicant shall, at her or his own expense, arrange for the screening of the film, advertisement or trailer, at a venue, date and time agreed to by the Board.

(f) Where a film has been classified under the Act, the person who applied for the classification of that film shall

  1. if it is a video or a disc, provide a copy thereof in the format in which the film was so classified;
  2. if it is not a video or disc but a video or disc version is published in the Republic, provide a copy of such version

free of charge to the Board. Such copy shall be kept and/or disposed of the by the Board at its discretion."

Short Title

  1. These regulations shall be called the Second Amendment to the Films and Publications Regulations, 1998.
