SEA FISHERY ACT, 1988 (ACT No. 12 OF 1988)
AMENDMENT OF REGULATIONS
The minister of Environmental Affairs and Tourism has, after consultation with the Sea Fishery Advisory Committee, under section 45 of the Sea Fishery Act, 1988 (Act No. 12 of 1988), amended the regulations promulgated in terms of the said Act, as set out in the Schedule.
SCHEDULE
1. "The Regulations" means the Regulations published under Government Notice No. R. 1343 dated 1 November 1997, as amended, by Government Notice No. R. 260 dated 13 February 1998.
2. Regulation 44 of the Regulations is hereby amended by the insertion in subregulation (2) of the words "and only" between the words "day" and "on" and by the substitution for the word "any" of the letter At".

3. Regulation 55 of the Regulations is hereby amended by the substitution in subregulation (2) for the words preceding paragraph (a) of the following words:
a(2) A permit issued under subregulation (1) shall authorise the holder thereof to catch collect or land not more than four west coast rock lobster per day and only on a Saturday, Sunday and a public holiday between the hours 08:00 to 16:00 by means only of".
4. Regulation 56A of the Regulations is hereby amended by the insertion of the following subregulation after subregulation (5):
~(6) The holder of a permit issued in terms of subregulation (2) shall immediately mark his or her catch by
(a) pulling the plastic wire us provided by Sea Fisheries through on of the breathing holes of the abalone in such a manner that if forms a loop through the which is firmly the identification tag as provided by Sea Fisheries, must be affixed;
(b) firmly attaching the identification tag as provided by Sea Fisheries, around the upper part of the tail nearest to the carapace of the west coast rock lobster.
(7) A person who has acquired abalone or rock lobster from a subsistence fisher shall not resell or otherwise trade such abalone or rock lobster and he may not remove the mark or tag from such abalone or rock lobster: Provided that the prohibition on the resale shall not apply in respect of a hotel or restaurant who serves cooked abalone or rock lobster for immediate consumption.".
