Truth and Reconciliation Commission: Committee on Amnesty

PROCLAMATION UNDER SECTION 20 OF THE PROMOTION OF NATIONAL UNITY AND RECONCILIATION ACT, 1995 (ACT NO. 34 OF 1995)

Notice is hereby given that amnesty in terms of section 20(1) of the Promotion of National Unity and Reconciliation Act, 1995 (Act No. 34 of 1995), was granted -

1. on 10 October 2000 to -
   1. KIMPANI PETER MOGAI (identity number 4805215560088), in respect of-

      (aa) the assault with the intent to do grievous bodily harm of JEROME JOSEPH MAAKE, committed at or near Tzaneen on or about 13 September 1982;
      (bb) perjury in an attempt to defeat the ends of justice in the criminal trial resulting from the above assault;
      (cc) any other offence or delict directly linked to the above assault and flowing therefrom; and
      (dd) any offence or delict linked to and flowing from the kidnapping, detention and interrogation of SELBY MAVUSO, also known as MK BAB, committed at or near Zeerust during or about 1981; and

   2. KOBUS KLOPPER (identity number 6612095169088), in respect of any offence or delict flowing from, and directly linked to, the arrest, detention and prosecution of MZWAKHE MBULI and his wife, MRS NOMSA MBULI, in connection with the so-called illegal possession of firearms and/or explosives, committed at or near 4437 Pimville on or about 17 March 1989;
2. on 11 October 2000 to -
   1. PAUL RAMOSETLHA RAMMUSI (identity number 6210225857084) in respect of-

      (aa) all offences and delicts flowing from or directly associated with a shootout with the police, committed at or near Springs during or about 1987; and
      (bb) all offences and delicts flowing from or directly associated with a hand grenade attack on the house of a policeman, one SEALOGO, committed at or near KwaThema, Springs during or about 1987;

   2. THEMBINKOSI HENCE (identity number 7504115584082), in respect of all offences connected with or flowing from an armed attack on a Translux Bus, committed at or near the Gamka River Bridge, Beaufort West on or about 27 August 1993;
   3. SGUBHU ABEL DUBE (identity number 5206265398089), in respect of the illegal possession of an AK-47 and a 9 mm luger pistol and ammunition, committed at or near Saambou Bridge, district of Pietersburg during or about April 1982;
   4. FERNANDO BRAIN NDHLOVU (identity number 6508235396088), in respect of-

      (aa) the handgrenade attack on the house of MANTOHANA HERBERT MATJOKANA, committed at house number 261, Emkanti Section, Tembisa, Gauteng during or about 1985; and
      (bb) all offences and delicts directly associated with or flowing from the attack; and

   5. MPADI JOHANNES LEDWABA (identity number 6805125354080), in respect of the offence of public violence, committed at or near Mogopong Township, Naboomspruit on or about 14 April 1993;
3. on 13 October 2000 to-
   1. ENOCH MSEBENZI NHLAPO (identity number 6307215357081); and
   2. JOSEPH HLAHANE (identity number 6003315333085), in respect of the unlawful possession of petrol bombs, committed at or near Ratanda in the district of Heidelberg on or about 7 October 1992; and
   3. ANDILE ARMSTRONG MNTU (date of birth 19 July 1969), in respect of-

      (aa) public violence, committed at or near Whittlesea, Zwelitsha during or about April 1993; and
      (bb) malicious damage to property, committed at or near Whittlesea during or about April 1993;
      

4. on 16 October 2000 to
   1. WILLEM JOHANNES COETZEE (identity number 5204095090000);
   2. LODEWYK DE JAGER (identity number 4701285033006);
      ANTON PRETORIUS (identity number 5804075046086); and
   3. IGNATIUS COETZEE (identity number 3902285027003), in respect of the arson attack on the Administrative Offices of Soyco, committed at or near the lpelegeng Community Centre, Soweto during or about 1986 or 1987; and
   4. MBONGO PETER FIHLI (identity number 68041015325082), in respect of-

      (aa) the illegal possession of an AK?47, committed at or near Sebokeng during or about December 1984; and
      (bb) public violence, committed at or near Sebokeng during or about 1984;

5. on 17 October 2000 to-
   1. MFANELO DAN MATSHAYA (identity number 6202225100086);
   2. PUMLANI KUBUKELI (identity number 6609285920080);
   3. LUPANDA NTIKINCA (identity number 7309285937080);
   4. MLUNGISI NYEMBEZI (identity number 6808225495084);
      (v) SOLOMZI THEOPHILUS NOMATSHIZOLO (identity number 7106016037085);
      and
      (vi) LUZUKI SYDNEY MPIYAKHE (identity number 8211245363086),
      in respect of transgressions of Act 54 of 1982 during attacks on the police barracks at Kokstad and on the Kokstad and Maclear Police Stations, committed during or about 1990;
6. on 20 October 2000 to LENNY BOLO (identity number 7207055669083), in respect of arson of a school building, committed at or near Kei Road Location, Kei Road on or about 17 August 1992;
   
7. on 25 October 2000 to-
   1. JOHANNES MUDIMU (identity number 5403065847080), in respect of-

      (aa) infiltrating weapons of war into the country; and
      (bb) assisting trained MK cadres in entering the country illegally, committed during or about the period 1986 to 1989; and

   2. NORMAN YENGENI (identity number 5810015647081), in respect of

      (aa) leaving the country without a passport;
      (bb) undergoing military training;
      (cc) entering the country illegally; and
      (dd) attempting to sabotage the Caltex Depot, committed in or near the Cape Province during or about 1980;

8. on 27 October 2000 to KABELO CAGNEY LENGANE (identity number 6207235905085), in respect of all offences and delicts arising from his participation in the detention and/or interrogation of-
   1. EDWIN VUYANI NKOMO;
   2. MBULELO ESAU MABENA;
   3. MSILANE RONEL SISHANGE;
   4. OSCAR AMOS MHLANGENI;
   5. SIMON MORRIS; and
   6. SEKANO AVONLY-KGASI, committed at or near Orlando East, Orlando West and Chiawelo in Soweto on or about 1 August 1986; and
9. on 30 October 2000 to-
   1. ROBERT LUCKY SIBEKO (identity number 7511245625081), in respect of the unlawful possession of petrol bombs in contravention of section 28(1), read with sections 1, 27(1)(c) and 28(2), of Act 26 of 1956, committed at or near Ratanda in the district of Heidelberg on or about 7 October 1992;
   2. MBULELO DAVID YELANE, in respect of public violence, committed at or near Phatsima, Rustenburg on or about 8 August 1993;
   3. TSHEDISO PETRUS MSHIWA (identity number 7108275626087), in respect of the unlawful possession of arms and ammunition, committed at or near Sharpeville, Gauteng on or about 19 November 1992; and
   4. ROBERTZAMZOLO NOGUMELA (identity number 5608015673085), in respect of-,

      (aa) the unlawful possession of arms and ammunition, committed in or near the district of East London during or about October 1990;
      (bb) any offence directly associated with or flowing from the supply of unlawful arms and ammunition to an MK unit, committed in or near Ciskei during or about 1992;
      (cc) any offence directly associated with or flowing from the supply of unlawful arms and ammunition to the Natal Region of the ANC, committed during or about 1993; and
      (dd) the unlawful possession of arms and ammunition, committed at or near Qumbu during or about 1993.
