PROCLAMATION
by the President of the Republic of South Africa
PROCLAMATION UNDER SECTION 20 OF THE PROMOTION OF NATIONAL UNITY AND RECONCILIATION ACT, 1995 (ACT NO. 34 OF 1995)
Notice is hereby given that amnesty in terms of Section 20(1) of the Promotion of National Unity and Reconciliation Act, 1995 (Act No. 34 of 1995), was granted-
(aa) the overpowering of prison warders VAN ROOYEN and KOMANE and holding
them as hostages; and
(bb) the threat to set the prison on fire, assault and any other offence
directly related to the above incidents;
committed at or near Boksburg Prison on or about 18 March 1994; and
(aa) the robbery with aggravating circumstances, of R2 265,00 cash,
a wrist watch and keys belonging to JOSE DE FREITAS ; and
(bb) the illegal possession of firearms and ammunition; committed at
or near Denver on or about 22 February 1994;
(aa) the murder of BAREND CONSTANT VAN WYK;
(bb) the robbery of a motor vehicle belonging to BAREND CONSTANT VAN
WYK; and
(cc) the unlawful possession of a firearm and ammunition; committed
at or near Sebokeng on or about 12 October 1993; and
(dd) the unlawful possession of three firearms and ammunition, committed
at or near Ennerdale during or about 1994; and
(aa) the murder of BAREND CONSTANT VAN WYK;
(bb) the robbery of a motor vehicle belonging to BAREND CONSTANT VAN
WYK; and (cc) the unlawful possession of a firearm and ammunition,
committed at or near Sebokeng on or about 12 October 1993;
(aa) the murder of JOHN JERLING;
(bb) the attempted murders of ABRAHAM JOHANNES WIESE HERBST, PIETER
AUGUSTYN, JAN JOHANNES NEL, HENRY SHAUN FERREIRA, JONATHAN SPARGS, CELLETE
BINALA, PATRICIA KOMANI and CLYDE SCHWARTZ;
(cc) malicious damage to property;
(dd) the unlawful possession of arms and ammunition:
(ee) the theft and robbery of three (3) vehicles:
(aa) the attempted murder of SGT. PHADI and the robbery of a firearm
belonging to him, committed at or near Daveyton during or about 1993;
and
(bb) the attacks on the Zenzele informal settlement, committed during
or about August 1993;
(aa) the murder of a person known as SHORTY, committed at or near the
FC camp at Lusaka in Zambia during or about 1981; and
(bb) being an accessory to the assault on persons known as DISCO, ACE,
WELLINGTON, OSKOSH, DADLA, DUMISANG and MOYSE DIYAN, committed at or
near Lusaka during or about 1979 to 1982;
(aa) offences and delicts directly linked to the kidnapping of PETER
THABULEKA;
(bb) the assault on PETER THABULEKA, committed in or near the district
of Pretoria during or about June 1986; and
(cc) the offences and delicts directly linked to the kidnapping of an
unknown person and the subsequent assault on him, committed at or near
Mabopane during or about 1986;
(aa) the killing of SIPHO NGEMA; and
(bb) any other offence or delict directly flowing from or associated
with this killing, committed at or near Manzini, Swaziland, on or about
6 January 1988;
(bb) JACOBUS ADRIAAN VORSTER (identity number 4802205108009); and
(cc)LAURENCE GERALD WASSERMAN (identity number 5510265221005), in respect
of all offences and delicts flowing from or directly associated with
the unlawful arrest and/or abduction, the unlawful detention and the
killing of BEKHAYANE MKHWANAZI (AKA MK TEKERE), committed at or near
Elandskop in the district of Pietermaritzburg during or about 1988;
(aa) the conspiracy to murder BARNEY MOPA, ANDREW MPHAHLELE and NELSON
PHENYASE;
(bb) the attempted murder of TICKY MALEKA and ANANIAS NKOANE;
(cc) the conspiracy to murder PATIENCE KULELE and the attempted murder
of ROSE-MARY MUZWAYINE;
(dd) the conspiracy to cause malicious damage to property, namely House
No 855, Mamelodi Gardens;
(ee) the conspiracy to murder MATILDA ELENORA VENTER, ELKE MARTHA HANSEN,
ANNA MARIA PRINSLOO, SUSANNA MARIA MAGDELENA KRUGER and ALIDA MARIA
CLAASEN;
(ff) the conspiracy to cause malicious damage to property, namely, an
SADF vehicle, the Golf Pro Business Enterprise Premises, the State Library,
the Magistrate's Office Building and the Old Mutual Building, committed
in the course of the execution of the "Juicy Lucy" bombing;
(gg) the conspiracy to place a bomb at Proes Street, Pretoria, and the
damage caused to a vehicle belonging to BR WALSTER, committed on or
about 26 May 1988;
(hh) the conspiracy to murder SIMON MYEKE and malicious damage to property;
(ii) the conspiracy to murder BANGIWE CHARLES NDLALA and RONALD MULATEDZI,
and malicious damage to property;
(jj) the conspiracy to commit malicious injury to property of the former
Department of South African Railways and Harbours, committed during
or about 1988;
(kk) the conspiracy to murder CONSTABLE MPAHLELE, and malicious injury
to property; the conspiracy to attack and murder members of the Bophuthatswana
Defence and Police Forces, committed during or about the 1980s;
(mm) the conspiracy to murder members of the South African Security
Forces in general and to cause injury to their
person and property, committed during or about the 1980s;
(nn) contravening the provisions of the Explosives Act;
(oo) defeating the ends of justice;
(pp) crossing international borders without a valid passport; and
(qq) contravening the provisions of the Arms and Ammunition Act;
(aa) the murder of MLIBO NAMBA, LOUIS BONISILE MAMA, NKOSIYEZWE ZONDI,
ZAMANI MVEKA, DALIWONGA NOTOTE MHAYA, WARRANT OFFICER NDABENI, GLADSTONE
MLUNGISELELI MOOI and MXOLISI NGWAGA;
(bb) the attempted murder of PRINDILE W. FATMAN, ZWELIDUMILE ABEL NXITYWA,
FEZILE MAJOBELA, STEMBELE MVULANA and SIPHIWE NDONGENI;
(cc) the malicious damage to the Madeira Street Police Station;
(dd) the unlawful possession of firearms and associated ammunition,
committed at the Madeira Street Police Station, at or near Umtata, on
or about 29 July 1986;
(ee) the attempted murder of NCEDILE EPHRAIM KUPE;
(ff) the unlawful possession of firearms and associated ammunition,
committed at or near Dweza on or about 22 January 1986;
(gg) the murder of COLBERT THAMSANGA NDZOBOLE;
(hh) one count of sabotage;
(ii) the unlawful possession and the transportation of explosives, committed
at the Botha Sigcau Building during or about 1986;
(jj) two counts of murder in respect of two unidentified victims;
(kk) an undetermined number of counts of attempted murder in respect
of those injured during the resultant blast one count of sabotage; and
(mm) the unlawful possession and transportation of explosives, committed
at the Mzamba Wild Coast Sun Hotel on or about 18 April 1986;
(aa) the illegal possession of explosives; and
(bb) the malicious damage of the Jukies Ice Rink, committed at or near
Welkom during or about 1985;
(aa) theft of motor vehicles;
(bb) battery; and
(cc) leaving the Republic of South Africa without valid travel documents,
committed during or about 1960 to 1963 and 1974 to 1994;
(aa) terrorism;
(bb) the unlawful possession of a firearm;
(cc) the unlawful possession of ammunition;
(dd) the unlawful possession of grenades, bombs and/ or projectiles;
(ee) the unlawful possession of explosives;
(ff) possession of a forged reference book, committed during or about the period 1977 to 1986;
(gg) all offences arising from activities, as a member of the PWV region MK command, in support of the SDU activities in or near Gauteng; and
(hh)the unlawful possession of arms and ammunition; and
- MAYNARD KHANDIZWE NHLABATHI (identity number 550616529088), in respect of all offences arising from activities with regard to assisting Freedom Fighters to enter South Africa from Swaziland which occurred during or about the period 1984 to 1990;
(aa) all offfences and delicts arising from the car bomb explosion,
committed in or near Quartz Street, Johannesburg, on or about 30 July
1987;
(bb) all offences and delicts arising from the establishment of an arms
cache, consisting of -
(cc) all offences and delicts arising from activities as a member of the command collective of the Special Operations Unit of MK in furnishing the necessary support to operatives of MK carrying out military operations inside South Africa, committed during or about the period September 1988 to December 1989;
(aa) all offences and any delicts flowing from the attacks;
(bb) arson;
(cc) malicious damage to property; and
(dd) the unlawful possession of petrol bombs, explosives and firearms
in contravention of the Explosives Act and the Dangerous Weapons Act,
committed in or near Lady Grey and Zastron during the early 1990s; and
